Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the website at amplicity.energy (the “Site”) and any other content, marketing materials or information we publish on it. By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please stop using the Site.

Use of our software products is governed by a separate written agreement signed between Amplicity and your organisation. These Terms do not grant you any rights to those products.

You must be at least 18 years old to use the Site, or the age of majority in your jurisdiction, whichever is greater. By using the Site you represent that you meet this requirement and that any information you submit is accurate.

You may use the Site for the following purposes:

• Learning about Amplicity, our products and our company.
• Submitting an enquiry through our contact form.
• Subscribing to receive marketing or product communications you have requested.

You agree not to:

• Use the Site in any way that violates any applicable law or regulation.
• Probe, scan or test the vulnerability of any system or network related to the Site without written permission.
• Interfere with or disrupt the integrity or performance of the Site, or attempt to gain unauthorised access to it.
• Use any robot, scraper or other automated means to access the Site, except for well-behaved search-engine crawlers.
• Reproduce, distribute, modify, create derivative works from, publicly display or commercially exploit any content from the Site without our prior written consent.

All trademarks, logos, software, text, images, illustrations, animations and other content on the Site are owned by Amplicity or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the Site for your personal, non-commercial use. No other rights are granted.

If you send us feedback, ideas or suggestions about our products or this Site, you agree that we may use them for any purpose without obligation to you, and that you have all necessary rights to share them. We will treat any personal data you provide in accordance with our Privacy Policy.

The Site may contain links to third-party websites, services or content that we do not control or endorse. We are not responsible for the availability, accuracy, content, security or privacy practices of any third-party site. Accessing them is at your own risk.

Information on the Site about expected savings, revenue, market access or system performance is based on assumptions and modelling and is provided for illustrative purposes only. To the maximum extent permitted by applicable law, Amplicity, its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages. Our total cumulative liability under these Terms will not exceed the greater of (a) the amount you have paid to access the Site (typically zero) and (b) USD 100.

You agree to defend, indemnify and hold harmless Amplicity from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your misuse of the Site.

We may update the Site, these Terms or any content at any time. If we make material changes to the Terms we will update the “Effective” date at the top of this page and, where appropriate, give a more prominent notice. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

We may suspend or terminate your access to the Site at any time, in our sole discretion, including for violation of these Terms. The provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnity, governing law) will survive any termination.

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts of Singapore, except where mandatory consumer- protection laws of your country of residence provide otherwise.
